Terms of service
Last updated: October 30, 2026
These Terms and Conditions ("Terms") govern your use of houseofmassagechairs.com and all purchases from House of Massage Chairs, whether made online or in one of our showrooms. They also govern the programs described in Part B. Our business is operated by Revive Massage Products Inc., doing business as House of Massage Chairs ("we," "us," "our"), at 925 Blossom Hill Road, Suite 1324, San Jose, CA 95123, United States.
Read section 25 before agreeing to these Terms. It provides for binding individual arbitration of most disputes, includes a class action waiver, and gives you 30 days to opt out.
When these Terms are presented for acceptance with an order, you agree to them by affirmatively accepting them and submitting the order or signing the applicable order form. The Shipping & Delivery Policy and Returns, Swaps & Cancellations Policy form part of the purchase agreement. The Privacy Policy explains our data practices and choices; acknowledging that notice is not consent to optional marketing or a waiver of privacy rights. Merely making these Terms available through a footer does not replace an acceptance process where one is required.
Specific terms disclosed and agreed before purchase control their subject if they differ from these general Terms, subject to mandatory law. A receipt provided after payment does not introduce a new final-sale restriction or remove a benefit already agreed. Nothing in these Terms waives a right or remedy that applicable law does not permit you to waive.
Part A contains the general terms in sections 1-19. Part B covers 6-Month Price Protection in section 20, the Upgrade Program in section 21, the Trade-In Program in section 22, the Service Discount Program in section 23, and price matching in section 24. Part C contains the dispute and other legal provisions in sections 25-29.
Part A General terms
1. Who may purchase
Orders may be placed by customers who are at least 18 and have legal capacity to enter into the purchase agreement. Supply correct order details and pay only with a payment method you have permission to use. Unless we give written approval otherwise, our products are offered for personal and household use, rather than resale.
2. Accepting and reviewing orders
- An online order is accepted when we email the order confirmation. A showroom purchase is accepted when its order terms, including the showroom final-sale notice, have been presented before commitment, the customer agrees, and we issue the order confirmation or sales receipt. Acceptance does not prevent cancellation in the circumstances described below.
- We may decline, restrict or cancel an order, even after confirmation, because of suspected fraud or resale, incorrect pricing or listing information, information we cannot verify, an unsupported delivery address, unavailable stock or similar order-related concerns. If we cancel your order, we notify you and refund the amount paid, including any applicable delivery payment, without a cancellation penalty and within the period required by law.
- Purchase quantities may be limited by customer, household or address.
Cozzia delivery restriction: House of Massage Chairs delivers Cozzia-branded products only to addresses in California. We do not ship or deliver Cozzia products to any other state. This restriction applies to online and showroom orders and to any swap, upgrade or trade-in purchase involving delivery of a Cozzia product. A Cozzia order with a delivery address outside California will be declined or canceled, and any payment collected for that canceled order will be refunded in full.
Sales channel matters: An in-person order accepted and recorded as a showroom purchase is final under section 10 of our Returns, Swaps & Cancellations Policy. Eligible independently placed online orders follow the online rules. An independent website purchase keeps its online status even if the buyer has previously visited a showroom.
Svago delivery: Svago recliners ordered from us may be shipped to eligible U.S. addresses outside California under our general delivery policy. Svago does not have a California-only delivery restriction. Recliner delivery and any additional service are determined by the product listing or written quote.
3. Prices and listing errors
- All prices are stated in U.S. dollars and may be revised. Your order uses the price in effect when it is placed, subject to the 6-Month Price Protection terms in section 20.
- A genuine pricing or availability error may require us to contact you about an order. We do not charge a higher price or substitute a materially different product without your agreement. If we cannot fulfill the order as agreed and cancel it, we provide the required refund without a cancellation fee; any corrected offer is yours to accept or decline.
- Unless a different basis is expressly identified, a price labeled "compare at" represents the manufacturer's suggested retail price, or MSRP, and is identified accordingly. A "was" price or other former-price comparison refers to a price at which we regularly offered the product during the preceding 90 days.
- Mandatory charges are included in a displayed total when required by law. Government-imposed taxes and reasonable shipping charges may be separately stated where permitted. Optional services and contingent return or redelivery charges are identified before you agree; we do not add an undisclosed mandatory handling charge at payment.
- Competitor prices are not matched for purchases subject to the current price-matching rules in section 24.
4. Sales tax
We collect sales tax when required by law. The amount appears at checkout or on your showroom receipt. Sections 21 and 22 explain how tax applies to purchases using upgrade or trade-in credit.
5. Payments and Affirm financing
- Full payment is required before we arrange a delivery appointment.
- Financing through Affirm is subject to Affirm's approval and separate terms. Affirm, rather than House of Massage Chairs, provides the financing. Purchases that use upgrade or trade-in credit cannot be financed through Affirm.
- If your purchase is financed, continue the required payments while a service request, swap, upgrade or return is being handled. Your payment obligations continue until Affirm confirms an adjustment.
6. Promotions and discount codes
- An offer is governed by its published conditions, including its dates and exclusions. Unless an offer expressly allows otherwise, only one code may be used per order. Codes cannot be sold, transferred, redeemed for cash or applied retroactively. Earlier purchases may qualify only under our 6-Month Price Protection terms.
- We may invalidate a code issued in error, distributed without authorization or used contrary to its conditions.
- Conditions for a free product or service are stated with the offer. New massage chair purchases include White Glove delivery at no additional charge except for the Solara, as provided in our Shipping & Delivery Policy. Upgrade Program purchases carry a $700 White Glove fee. An eligible voluntary return of a non-defective chair we have set up carries the disclosed $700 White Glove service deduction under our Returns, Swaps & Cancellations Policy, even when initial setup was included at no additional purchase charge. This contingent deduction must be disclosed before purchase and is not charged for an unperformed service, charged twice, or applied where prohibited by law.
7. Product descriptions
We make reasonable efforts to maintain accurate product information. Much of the specification, feature and image information comes from manufacturers and may change. Screen settings may affect how colors appear. Before ordering, review the product's dimensions, user height and weight limits, and electrical requirements, or ask us for help. We may correct listing errors, but a later correction does not authorize us to change the agreed model, material features, condition or included service on an accepted order without your agreement. Applicable remedies for a materially misdescribed or incorrect item remain available.
8. Health and safe operation
- Our products are intended for comfort and relaxation. Unless a manufacturer expressly states otherwise, they are not medical devices and are not intended to diagnose, treat or cure a health condition.
- Consult your doctor before use if you are pregnant, have a pacemaker or another implant, have recently undergone surgery, or have osteoporosis, a circulation disorder, a spinal condition or another health concern.
- Observe the manufacturer's instructions, safety warnings, and height and weight restrictions. Supervise children and keep them clear of moving mechanisms.
- We do not decide whether a purchase qualifies for HSA or FSA payment. Ask your plan administrator or tax advisor about eligibility.
9. Delivery and responsibility for loss
Our Shipping & Delivery Policy governs delivery, including the California-only restriction for Cozzia products. Risk of loss transfers to you when the product is delivered or collected at a showroom.
10. Returns swaps and showroom final sales
Showroom purchases do not include voluntary cancellation, returns for a cash refund or store credit, or the free 30-Day Swap. There is no voluntary 24-hour showroom cancellation period. These terms are presented before purchase and are subject to mandatory legal rights and any specific written benefit supplied with the order. Independent online orders follow the separate online terms in our Returns, Swaps & Cancellations Policy, including the return window and disclosed deductions. A showroom visit does not convert a later independent website order into a showroom order.
The fee-based Upgrade Program is a separate purchase option available for an eligible chair after delivery, including within the first six months. It does not create a cash-return entitlement. An otherwise eligible price-protection adjustment remains available for a final showroom sale. Defective, damaged, incorrect, materially misdescribed or undelivered goods are addressed under the applicable warranty and law; final sale does not mean that every remedy is unavailable.
11. Manufacturer warranties and legal warranty rights
Manufacturer's written warranty: New products include the applicable manufacturer's warranty described for that product. The warranty document identifies its provider, duration, covered parts and labor, exclusions, service arrangements and any geographical limits. You may review it before purchase on the product page or request a free copy. We help route claims to the manufacturer or authorized network; doing so does not eliminate any responsibility imposed on us as the retailer.
Retailer obligations and implied warranties: We do not offer a separate written store warranty unless expressly issued. Any applicable implied warranties of merchantability or fitness, statutory duties and remedies remain available. A manufacturer-warranty referral, final-sale label or 30-day reporting process does not disclaim them. California warranty duration and remedies follow the applicable law, including the rules for new and used goods; a warranty coverage period is not necessarily the deadline for bringing a claim about a defect covered during that period.
Service and remedies: Follow the product's safe-use and maintenance instructions and contact us promptly with a problem. Diagnosis, repair or replacement may be appropriate depending on the warranty and law. Where the applicable legal conditions for a refund, reimbursement or other remedy are met, those rights remain available and are not replaced by a required upgrade or store credit. We do not assess voluntary-return deductions on a warranty remedy where prohibited.
Display or as-is goods: A display or clearance designation alone is not a waiver of every warranty. Any particular known condition or legally permitted as-is disclaimer must be clearly identified before purchase in the form required by law. It cannot excuse fraud, misdescription, personal-injury liability or other nonwaivable obligations.
Extended service plans: Optional extended plans are governed by their own documents and applicable law, including any cancellation or refund rights. The provider, coverage and price are disclosed before purchase. An upgrade, trade-in or showroom final-sale rule does not automatically cancel a statutory plan right.
Website operation: The website is supplied as is and as available to the extent permitted by law. We do not promise uninterrupted operation or that every technical error can be prevented. This statement concerns the website and does not disclaim the legal warranties on the products we sell.
12. Limits on liability
To the extent a limitation is permitted by applicable law, we exclude indirect, incidental, special, consequential and punitive damages, including lost profits, savings and data, and limit aggregate contractual liability for a product or order to the amount paid for that product or order.
These limitations do not restrict liability for fraud, willful misconduct, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited. They do not reduce nonwaivable warranty or consumer remedies, required refunds, statutory damages, recoverable attorney fees or rights under applicable product-liability law. If the law of your state provides a protection that cannot be waived, that protection controls. A savings clause is not used to enforce an otherwise unlawful limitation.
13. Delivery service and other independent providers
We use delivery teams, manufacturers and their authorized service networks, payment processors and financing providers to help complete purchases and support. Each provider may have separate terms for its own service. We remain responsible for our contractual and statutory obligations and do not use a provider's involvement as a blanket disclaimer of them.
Report damage to your property promptly, preferably with photographs and the delivery details. We assist in identifying the responsible delivery provider and making a claim. Responsibility is determined by the applicable law and facts; this policy does not require you to waive a claim against us or an involved provider as a condition of receiving the product. Affirm remains the provider of any Affirm loan, and the manufacturer's written warranty identifies its warrantor.
14. Order communications marketing and call recording
We and providers assisting with your order may use the contact details supplied to communicate about delivery, payment, returns, swaps, upgrades, warranty support, security and other requested services, as permitted by law. Contact us if those details change.
Marketing emails and texts are governed by separate choices and any required consent. Purchasing, accepting purchase terms, acknowledging a privacy notice or giving a telephone number for delivery is not, by itself, consent to promotional texts. Marketing consent is not a condition of purchase. You may unsubscribe from promotional emails or reply STOP to promotional texts; applicable carrier charges may apply. Necessary service communications may continue by a permitted method.
If a call is recorded, we give notice and obtain consent where required before recording the conversation. You may request an available alternative way to communicate. The Privacy Policy explains related information handling and rights.
15. Account security
Protect your account credentials. Notify us promptly if you believe your account has been accessed or used without authorization.
16. Reviews and submitted content
- Reviews, photographs and comments must be lawful, truthful and based on your own experience. By submitting them, you authorize us to use, display and share that content in connection with our business together with your display name.
- We do not pay for reviews or solicit only favorable reviews.
- We may reject or remove content that is unlawful, abusive, obscene, spam, unrelated to the subject, fabricated, contains another person's private information or violates another person's rights. A negative opinion alone is not grounds for removal.
17. Misuse of our website and programs
You may not commit fraud, submit false claims, abuse our return, swap, upgrade, trade-in, warranty, price protection or discount programs, use bots or scraping tools without permission, disrupt the website or its security, copy our content without permission, impersonate someone, or threaten or harass our employees or partners. We may respond by declining service, canceling orders or suspending website access.
18. Ownership of website materials
Our website's text, design, images, software and other content belong to us or our licensors and are protected by applicable law. Copying, republishing or commercial use requires our prior written permission. The brands and trademarks displayed remain the property of their respective owners.
19. Questions about a payment
Please contact us promptly if you believe a charge is incorrect so we can investigate. This request does not require you to contact us before exercising a statutory billing-dispute right, waive a legitimate chargeback, or delay any deadline imposed by your payment provider or law. If a payment dispute is opened, we may provide the payment provider with relevant order, delivery, communication and inspection records.
Part B Programs
20. Six Month Price Protection
Our 6-Month Price Protection covers qualifying reductions in our publicly advertised price for an eligible new massage chair. The six-month period begins on the purchase date shown on the original order or receipt, and the exclusions below apply.
Black Friday and Cyber Monday are included; clearance is excluded
- An otherwise eligible purchase made at a Black Friday or Cyber Monday price is covered for six months from its original purchase date. For an earlier eligible purchase still within its six-month period, eligible lower Black Friday and Cyber Monday prices also qualify for comparison. The clearance and other exclusions below still apply during those events.
- Clearance, closeout, liquidation, discontinued-stock and final-sale clearance purchases are not eligible. These classifications must be identified on the product listing, written offer or receipt before the purchase is accepted.
- Clearance prices, closeout prices, liquidation prices and discontinued-stock clearance prices cannot be used as comparison prices for another purchase, even if the comparison concerns the same model or the clearance offer runs during Black Friday or Cyber Monday.
- The same exclusions govern purchases made online and in our showrooms. They apply only prospectively to purchases governed by this version; they do not reduce coverage previously promised for an earlier order.
Which purchases qualify
- The original purchaser of an eligible new massage chair bought directly from us online or at one of our California showrooms may request an adjustment.
- Regular-price and public sale purchases, including eligible Black Friday and Cyber Monday purchases, can qualify unless an exclusion in these terms applies. Promotional status alone does not disqualify a purchase or comparison price.
- The program covers massage chairs. Recliners, including Svago recliners, office chairs, foot massagers, accessories, replacement parts, gift cards and extended warranty plans are not included unless separate written coverage was expressly offered before purchase.
- Floor or display models, open-box, refurbished, clearance, special-order and "as-is" items are excluded. Purchases using upgrade credit, trade-in credit, individually negotiated pricing, employee pricing, the Service Discount, or a code restricted to a selected person or group are excluded.
- Canceled or returned purchases do not qualify. The program belongs to the original purchaser and cannot be transferred to another order or customer.
Which lower prices qualify
The comparison must be our own publicly advertised price for the identical new brand, model, finish and configuration, with materially equivalent warranty, delivery terms and included items. The product must be available for purchase from us at that price. Public website prices, published advertisements, showroom price tags and generally available public codes may qualify, including eligible Black Friday and Cyber Monday offers, subject to the clearance and other exclusions in these terms.
Other retailers' prices, pricing errors, private quotations, employee or group prices, restricted codes, financing incentives, free gifts, bundled value, delivery charges, White Glove charges, upgrade charges and taxes are not eligible comparison savings. Gifts and financing offers are not assigned a cash-equivalent saving under this program.
Requesting an adjustment
The period is six calendar months, not a rolling period restarted by each price adjustment. If the corresponding calendar date does not exist in the sixth month, that month's last day is used. A timely documented request is not lost because our review occurs later.
Contact us through our Price Protection page, by email or phone, or at the showroom where you purchased. Provide the original receipt or order number, the exact model and finish, and the lower price, with a link, advertisement or dated screenshot where available. We must receive the request within six months of the original purchase date. The price must be available when the request is made; a later price change does not by itself invalidate timely evidence of an otherwise eligible price. We verify requests against our own price and order records and may ask for information reasonably needed to confirm eligibility.
Calculation and payment
- The adjustment is the eligible item price actually paid, less any price-protection adjustments already issued, minus the new eligible lower item price. Discounts are counted once. The calculation excludes delivery, taxes, service fees and non-item promotional value; any legally required sales-tax adjustment is handled separately.
- Each distinct eligible price drop can produce an additional adjustment, but the same reduction is not paid twice. Total adjustments cannot exceed the amount actually paid for the eligible item. The original six-month period continues after an adjustment and does not begin again.
- After approval, we aim to issue the adjustment within five business days to the original payment method. Your bank may take additional time to post it. For an Affirm purchase, the adjustment is sent to Affirm and applied under the loan terms.
- If the product is later returned under an applicable return right, amounts already refunded as price protection are deducted to prevent a duplicate refund.
Relationship to returns and other programs
A qualifying price adjustment is separate from a product return. An otherwise eligible showroom purchase can receive a price adjustment even though showroom purchases are final. Black Friday and Cyber Monday coverage does not change the return or swap eligibility of a purchase; the Returns, Swaps & Cancellations Policy determines those rights. A clearance item identified as final sale remains subject to its separate final-sale rules and nonwaivable legal rights.
Earlier purchases and program changes
Earlier orders retain the terms actually provided when they were purchased, including any then-applicable Black Friday coverage, retroactive eligibility previously granted, and the original end date of their six-month period. We will not use these new exclusions, a later policy revision or a later change of label to take away that earlier promised coverage. If we change or end the program, qualifying purchases made while the relevant version was active retain the coverage promised under that version. The program does not guarantee any future price or require us to offer a promotion.
21. Upgrade Program
Once your eligible massage chair has been delivered, you may request an upgrade, including during the first six months. There is no six-month waiting period. The upgrade credit and fees belong to a separate program from the 30-Day Swap or a right to return the product.
Credit schedule
Time is measured from the original purchase date shown on the receipt. First-year credit is available after delivery, rather than only after six months.
| Time since original purchase | Upgrade credit |
|---|---|
| After delivery through 12 months | 80% of the eligible original purchase amount, capped at 50% of the new chair's regular price |
| More than 1 year through 2 years | 60% of the eligible original purchase amount |
| More than 2 years through 3 years | 40% of the eligible original purchase amount |
| More than 3 years through 4 years | 20% of the eligible original purchase amount |
| More than 4 years | Individual assessment based on model, condition and current market value; the Trade-In Program may also be available |
For example, if the eligible original purchase amount is $10,000 and you upgrade three months after purchase to a chair with a regular price of $12,000, 80% would be $8,000, but the first-year cap limits the credit to $6,000. Upgrade charges and applicable taxes are additional. At 18 months, a $10,000 eligible original purchase amount produces $6,000 in credit under the second-year schedule.
Eligibility and credit basis
- You must be the original purchaser of a new massage chair bought directly from us, online or in a showroom. Eligible chairs purchased before this program was published are included, subject to any different written terms supplied with that chair.
- Floor models and clearance items are ineligible. This massage-chair program does not automatically cover recliners, including Svago recliners, or other product categories.
- You must still own the chair, without a lien or unpaid lease. Any existing financing continues under its own terms; upgrade credit does not settle the loan.
- The eligible original purchase amount is the item price actually paid after discounts, less any price adjustments already received and any portion paid with trade-in or upgrade credit. Sales tax, delivery charges, upgrade fees and extended warranty plans are excluded.
Replacement purchase
Buy a new massage chair from us at its regular price, which must be higher than the eligible original purchase amount of your current chair. Credit cannot be used against a sale or promotional price, a clearance item or a floor model. A chair may be surrendered for one upgrade. For the replacement chair, a new schedule runs from its purchase date and is based on the amount actually paid for it after the exclusions above.
Condition and inspection
The current chair must work, include its remote and all parts, retain its serial-number label, and have no damage beyond normal wear. It must be free of pests, mold, smoke damage and pet damage. We inspect at collection. If it fails these conditions, we show you the issue and deduct the reasonable repair cost from the estimated credit. You may instead retain the old chair and repay the entire credit. By participating, you authorize a charge for the applicable credit adjustment to the payment method used for the replacement purchase, subject to applicable payment authorization requirements.
Quote and collection
- Contact us by phone, email or at a showroom. We provide a written quote showing the credit, fees, tax and total balance before you commit.
- Choose the replacement and pay the balance using an accepted payment method. The credit is applied to that purchase only.
- When the replacement is delivered, we collect and inspect the old chair at the same address. It must be empty, unplugged and accessible along the same route. Ownership transfers to us at collection.
Upgrade charges
| Service | California | Other contiguous U.S. destinations |
|---|---|---|
| White Glove delivery and setup of the replacement | $700 | $700 |
| Collection of the old chair | $700 | $1,300 |
Every upgrade carries these charges. Alaska and Hawaii charges are quoted in writing before purchase. Brand-specific delivery restrictions in our Shipping & Delivery Policy continue to apply.
Other conditions
- Upgrade credit cannot be combined with trade-in credit, the 5% Service Discount, sale prices or discount codes. The same chair cannot generate both upgrade and trade-in credit.
- Upgrade purchases do not qualify for 6-Month Price Protection or Affirm financing. You may pay the balance using another method we accept.
- Credit has no cash value, cannot be transferred, split or saved for another purchase, and does not buy back the old chair for cash.
- Sales tax follows the law of the delivery state. In California, it is generally based on the replacement's full price before upgrade credit. Tax paid on the original purchase is not refunded.
- Any effect on an extended plan for the old chair, including transfer, cancellation or a refund, follows that plan and applicable law. The Upgrade Program does not independently terminate a protected plan right.
- A showroom upgrade purchase is final under the showroom rules. Any qualifying online return of a replacement follows the online return policy and is based on the amount actually paid. For a voluntary return, upgrade credit is not refunded and the surrendered chair cannot ordinarily be returned. This limitation does not reduce consideration or restitution that must be restored for a legally required remedy.
- If your original online order qualifies for the 30-Day Swap, that option remains available during its own window. Choosing an upgrade instead requires a separate written quote; the two programs cannot be combined for the same exchange.
Program changes
We honor the credit schedule and written upgrade terms applicable to your chair when purchased. For chairs predating publication of the program, this schedule applies unless different written terms were supplied. The removal of the waiting period is an additional early-use option; it does not reduce an existing written benefit. If the program is changed or ended, chairs purchased while it was active retain their applicable schedule. Void where prohibited.
A replacement Cozzia chair can be delivered only to an address in California. Svago delivery outside California is permitted under the general delivery policy, but Svago recliners do not automatically qualify for the massage-chair Upgrade Program.
22. Trade In Program
When buying a new massage chair in person at one of our California showrooms, you may trade in an older chair for up to $2,000 toward the new purchase. Brand and age determine the credit, and the maximum does not apply to every chair. If the older chair was purchased from us, consider the Upgrade Program in section 21, which may provide more credit.
Who and what qualifies
- The replacement must be a new massage chair purchased in person at our San Jose or Pleasanton showroom and delivered to a California address. Online orders do not qualify.
- We accept massage chairs of any brand or age, whether working or not, subject to the pickup requirements below.
- You must own the chair outright. Leased, rented or financed chairs with an unpaid balance, and chairs subject to a lien, are ineligible.
Valuing your chair
Bring photographs of the chair and its identifying label, including brand, model, serial number or manufacture date, to a showroom. We provide a written estimate based on brand and age, up to $2,000. That estimate remains valid for 14 days. We confirm the final credit when we inspect the chair at collection.
Completing a trade-in
- Present your photographs at a showroom and obtain an estimate.
- Purchase the new chair. The trade-in credit appears on your sales receipt.
- At delivery of the new chair, we collect the old chair from that address and verify its brand, model and age.
If the chair's brand, model or age differs from the information supplied, we tell you the revised credit before collection. You may accept the revision and pay the difference, or retain the old chair and repay the entire credit. By participating, you authorize us to charge the relevant amount to the payment method used for the purchase.
Collection requirements
- The old chair must be at the new chair's delivery address, empty, unplugged and accessible along the same route.
- Remove all personal property. We are not responsible for belongings left in or on it.
- We may refuse collection if the chair has bed bugs or other pests, mold or contamination, or cannot be moved safely. In that event, the credit is removed and you owe the full credited amount.
- Ownership transfers at collection. We may resell, donate, recycle or dispose of the chair.
Using the credit
- Credit applies only to a new massage chair at regular price in the same transaction, with one trade-in allowed per replacement chair.
- It cannot be used on sale or promotional prices, clearance items or floor models.
- A trade-in purchase cannot use Affirm financing and is excluded from 6-Month Price Protection.
- Credit cannot be combined with upgrade credit, the 5% Service Discount or discount codes.
- Credit cannot be redeemed for cash, transferred, sold or saved for another purchase.
The credit reduces the amount you pay, while sales tax is calculated as California law requires, generally on the price before the credit is subtracted. If you return the new chair, your refund is based on the amount actually paid under our Returns, Swaps & Cancellations Policy. For a voluntary return, trade-in credit is not refunded as cash or store credit and the surrendered chair cannot ordinarily be returned. Any restoration of consideration required for a statutory remedy is determined under the applicable law rather than excluded by this program.
We may revise or discontinue this program. A change does not affect a trade-in already recorded on your sales receipt. Void where prohibited.
23. Service Discount Program
Eligible customers receive 5% off the regular price of a new massage chair through our Service Discount Program.
Eligible customers: You must be at least 18 and belong to one of these groups:
- U.S. Armed Forces active-duty, Reserve or National Guard members, or U.S. military veterans.
- Firefighters.
- Law enforcement officers.
- Teachers or faculty members at a school, college or university.
- Students currently attending a college, university or trade school.
Verifying eligibility: In a showroom, present a valid document showing your status, such as a military or veteran ID, badge or school ID. We examine it without copying or retaining it. For online purchases, contact (669) 214-8889 or info@houseofmassagechairs.com before ordering. If verification is available at checkout, you may complete it through our verification partner. Additional information may be requested when status cannot be confirmed.
Eligible items: The discount is 5% of the regular price of new massage chairs. Sale and promotional prices are excluded. It does not apply to clearance merchandise, floor models, special orders, gift cards, extended warranty plans, delivery, upgrade charges or taxes.
Limits
- One discount is allowed per order. It cannot be combined with another service discount, another code or coupon, trade-in credit or upgrade credit.
- It is for personal purchases, not resale, and quantity limits may apply.
- It cannot be added to an earlier purchase.
- A return is refunded using the discounted price actually paid.
- If eligibility was misrepresented, we may cancel the order or charge the amount of the discount.
Verification information is used only to establish eligibility and maintain discount records, as explained in our Privacy Policy. We may change or end the program without affecting orders already placed. Void where prohibited.
24. Matching another retailer's price
We do not match competitor prices for purchases made on or after the effective date of these updated terms.
Purchases governed by an earlier 90-Day Price Match retain that protection. Under that program, an advertised lower price from a local authorized retailer for the identical new product, including the same brand, model number and materials, within 90 days after purchase qualifies for a credit of the difference. Submit the advertisement within the applicable claim period. Any written transition deadline already promised for that purchase remains available.
The comparison includes sales tax, delivery method and delivery charges. Floor samples, special orders, clearance or "as-is" products, liquidation or going-out-of-business sales, and unauthorized sellers are excluded.
Part C Disputes and other legal provisions
25. Resolving disputes and individual arbitration
25.1 Written notice and informal resolution. Before either party begins arbitration or a court proceeding, that party must give written notice identifying its name, contact information, order number, the problem and the requested outcome. Send your notice to info@houseofmassagechairs.com or the mailing address in section 29. We must give equivalent notice of a claim against you. Both parties will make a good-faith effort to resolve the matter for 60 days. Claim-filing deadlines are suspended during that period to the extent legally permitted. This process does not prevent a timely small-claims filing, an urgent application for relief, a complaint to a public authority, or another step necessary to preserve a nonwaivable right.
25.2 Binding arbitration. If informal efforts do not resolve the dispute, you and we agree to binding arbitration on an individual basis for disputes involving these Terms, the website, purchases, products, programs, services or our communications. The American Arbitration Association (AAA) will administer the proceeding under its Consumer Arbitration Rules, available at adr.org. The Federal Arbitration Act governs this section.
25.3 Exceptions. Either party may bring a qualifying individual claim in small claims court or seek court relief for misuse of intellectual property. The right to seek public injunctive relief in an appropriate forum is preserved. A court determines the availability and timing of any stay as permitted by law; this agreement does not require a waiver of that relief or impose an unlawful delay on it.
25.4 Costs and hearing location. We pay AAA filing, administration and arbitrator charges except the portion of the filing fee assigned to you by the AAA Consumer Rules. We will also pay your portion if you demonstrate that you cannot afford it. Each party bears its own legal fees unless an award of fees is authorized by law. Arbitration takes place in your county of residence or, where the rules permit, by telephone, video or written submissions.
25.5 Individual proceedings only. Claims may proceed only for an individual party, and not as a plaintiff or member of a class, collective or representative action. The arbitrator may grant relief only to that individual party. If a court finds this waiver unenforceable for a particular claim or remedy, that claim or remedy may proceed in the appropriate court, with sequencing and any stay determined as permitted by law.
25.6 Coordinated filings. If at least 25 similar arbitration demands are brought by, or with the assistance of, the same or coordinated lawyers, AAA's applicable rules and fee schedules for multiple or mass filings apply.
25.7 Decisions about this agreement. A court determines whether an arbitration agreement was formed and any issue that applicable law reserves to a court. Subject to those limits, questions about scope and enforceability are for the arbitrator, except that a court decides issues concerning sections 25.5 and 25.6 and the preservation of public injunctive relief.
25.8 Opting out. Within 30 days after you first affirmatively accept the arbitration agreement presented to you, you may opt out of this arbitration agreement. Email info@houseofmassagechairs.com with the subject "Arbitration opt-out" and provide your name, address and order number if one exists. The remainder of these Terms continues to apply.
25.9 Amendments. An amendment to this section does not apply to a dispute already reported under section 25.1. You may reject an amendment by emailing us within 30 days after it is posted.
26. Applicable law and courts
California law governs these Terms and disputes between you and us, without applying conflict-of-law rules. The Federal Arbitration Act governs section 25. Subject to applicable jurisdiction and venue rules, matters outside arbitration will be heard by the state or federal courts in Santa Clara County, California. This does not override a qualifying small-claims option, a legally protected public-injunctive-relief claim or a nonwaivable right to another venue. This provision does not take away any protection under your home state's law that cannot legally be waived.
27. Updating these Terms
We may publish revised Terms with a new update date. Revisions apply to website use and orders after publication. The version in effect when you placed your order continues to govern that order.
28. Other agreement provisions
- If a provision is unenforceable, the remaining provisions continue to apply.
- Not exercising a right does not waive that right.
- You cannot assign your rights under these Terms. We may assign ours in connection with a business sale or reorganization.
- We are not responsible for a delay or failure resulting from events outside our reasonable control.
- Notices may be delivered by email or by publication on our website.
- These Terms and the policies incorporated above form the complete agreement between you and us concerning their subject matter.
